RAW Sports Liability Waiver

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ IT CAREFULLY.
To: RAW Sports (hereafter referred to as “RAW Sports”)
In this agreement the term “Activities” shall include but is not limited to: football drills, gameplay and practice scenarios, instructional skill sessions, conditioning, stretching and mobility, strength and weight training, consumption of food and beverage, transportation to and from activities, and other such activities and services provided by or for RAW Sports in any way connected with or related to those activities or services above.
Who is signing this agreement
In this Agreement, “Participant” means the person named below who takes part in the Activities. Where the Participant is under the age of 18, this Agreement is signed by their parent or legal guardian, and “I” means both the Participant and the parent or legal guardian signing on their behalf. A separate agreement is completed for each Participant.
Acknowledgement — health and safety
I declare the Participant to be physically sound and suffering from no condition, impairment, disease or other illness that would prevent their participation in the Activities, and I assume all responsibility for their participation. I acknowledge that the Participant has been advised to wear an approved helmet and gear when required. I am aware that coaches and instructors are available to answer any questions as to the proper completion of any task. I undertake and agree that the Participant will remove themselves from participation if they sense or observe any unusual hazard or unsafe condition, or if at any time they feel unable or unfit to safely continue for any reason. I understand that the sole responsibility for the Participant’s personal safety remains with the Participant and with me, including their physical and emotional preparation and fitness to participate in the Activities.
Assumption of risks
I am aware that the Activities involve many risks, dangers and hazards, and that injuries are a common and ordinary occurrence. These risks, dangers and hazards include but are not limited to: in-game injuries, whether self-inflicted or caused by teammates or opposing players; injuries sustained during practice, strength training or conditioning; collisions with others, trips, falls, dives, legal or illegal football contact, tackling, pushing and dynamic movements; exposure to weather; negligence of other participants; allergy or other adverse reactions to provided food or beverage; and NEGLIGENCE ON THE PART OF RAW SPORTS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, VOLUNTEERS, SPONSORS, SUCCESSORS, ASSIGNS AND ALL OTHERS WHO ARE INVOLVED (collectively, “THE RELEASEES”), INCLUDING BUT NOT LIMITED TO THE FAILURE ON THE PART OF RAW SPORTS OR THEIR STAFF TO SAFEGUARD OR PROTECT THE PARTICIPANT FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES.
I am also aware that the risks, dangers and hazards referred to above exist throughout the area used for the Activities and may not be anticipated. The Participant is participating voluntarily. I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death or property damage and loss resulting therefrom, due to any cause whatsoever and without limitation.
Release of liability, waiver of claims and indemnity
In consideration of RAW Sports allowing the Participant to take part in the Activities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I agree as follows:
TO FOREVER WAIVE AND DISCHARGE ANY AND ALL CLAIMS that I have or may in the future have against the Releasees, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I or the Participant may suffer, or that our next of kin may suffer, resulting from participation in the Activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE (IN THE ACT OR OMISSION), BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE ON THE PART OF THE RELEASEES, AND ALSO INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT THE PARTICIPANT FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES, as referred to above;
TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property or personal injury to any third party resulting from the Participant’s participation in the Activities; and, where I sign this Agreement as parent or legal guardian, TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any claim, demand, action or expense (including legal fees and disbursements) brought by or on behalf of the Participant, or by any other person, arising out of the Participant’s participation in the Activities, including any claim founded in the negligence of the Releasees;
In the event of an accident or injury, I AUTHORIZE RAW SPORTS and/or its service providers to obtain medical assistance deemed necessary in their discretion for the Participant. I further assume responsibility to pay for any and all medical and emergency expenses, including transport, in the event of an accident or injury during the Activities, regardless of whether I have subsequently authorized such expenses;
This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and representatives, and those of the Participant, in the event of death or incapacity;
This Agreement and any rights, duties and obligations as between the parties shall be governed by and interpreted solely in accordance with the laws of the Province of Alberta, and no other jurisdiction;
Any litigation involving the parties to this Agreement shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the Courts of the Province of Alberta; and
This release and waiver is intended to be as broad and inclusive as permitted by the laws of the Province of Alberta, and if any portion is held invalid it is agreed that the balance shall nonetheless continue in full legal force and effect.
Acknowledgement and acceptance
In entering into this Agreement I am not relying upon any oral or written representations or statements made by the Releasees with respect to the safety of the Activities, other than what is set out in this Agreement.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING IT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I, THE PARTICIPANT, OR OUR HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
Parent or guardian
I am the parent or legal guardian of the Participant named below, and I have legal authority to sign this Agreement on their behalf. I have read and fully understood this Agreement, including the sections describing the risks of the Activities and the release of RAW Sports from liability for its own negligence. I consent to the Participant taking part in the Activities.
